Grant of License: Subscribing instructors are granted a non-exclusive, non-transferable license to use the full Metafit™ track library for the sole purpose of delivering live fitness classes.
Subscription Options: The Metafit Programme is available through either a monthly or annual subscription. Both plans provide full access to the entire Metafit™ track library for the duration of an active subscription.
Track Library Access: All current and historic Metafit™ tracks are included as part of your subscription. No individual track purchases are required or offered. New tracks will be released monthly and automatically added to your library.
License Validity: Your license to use any Metafit™ tracks is contingent upon maintaining an active subscription. If your subscription ends or is cancelled, your access to the track library will be revoked immediately, and you must cease all use of Metafit™ content.
Reactivation: If your subscription is reactivated, your license and access to the full Metafit™ track library will be reinstated, subject to the terms in effect at the time of reactivation.
Subscription-Based Access (Post-February 15, 2025): As of February 15, 2025, access to MetaPWR tracks operates under the same model as the Metafit Programme. Subscribers gain access to the entire MetaPWR track library for the duration of an active subscription.
Legacy License for Purchased Tracks (Pre-February 15, 2025): Instructors who purchased MetaPWR tracks prior to February 15, 2025 retain a perpetual, non-transferable license to use those specific tracks indefinitely, regardless of their current subscription status.
License Validity: Any new access to MetaPWR tracks requires an active subscription. If your subscription ends, you may continue using only the legacy tracks purchased before February 15, 2025. All other access is revoked.
Reactivation: Subscriptions can be reinstated at any time, at which point full library access resumes.
Perpetual License Upon Course Completion: Instructors who successfully complete MetaPRO or MetaCub certification courses are granted a non-transferable, perpetual license to deliver classes using those respective programmes.
Track Access: Certified instructors of MetaPRO and MetaCub receive ongoing access to their respective programme track libraries upon course completion and may be used indefinitely, so long as they have an active Metafit subscription.
Account Deletion: If your Metafit account is deleted (see Clause 7.3.1), all licenses—across Metafit™, MetaPWR, MetaPRO, and MetaCub—are permanently revoked. Access to all track libraries is removed and all associated usage rights are terminated.
Auto-Renewal: Subscriptions renew monthly on your Billing Date, unless cancelled in accordance with these terms.
Cancellation: Cancel any time via your payment provider (e.g., PayPal, Stripe) or via your online Metafit account. Access continues until the current billing period ends.
Refunds: Refunds are not guaranteed and are granted at the sole discretion of DRS Training Pty Ltd in exceptional cases.
Billing Responsibility: You are responsible for maintaining accurate billing details. Failure may lead to service disruption or cancellation.
Fee Changes: Subscription fees may be updated with prior notice. Changes apply from your next billing cycle.
Re-Subscription: Rejoin the Metafit Programme within 12 months of cancellation. After 12 months, please contact Metafit™ to explore options.
Termination: We reserve the right to suspend or terminate subscriptions immediately for breach of these terms.
Payment Providers: Subscriptions are processed via third-party providers. You must provide and maintain valid payment credentials.
Compliance: Adhere to your payment provider’s terms, including applicable fees and chargeback policies.
Security: Payment data is handled securely by third parties; Metafit does not store full payment details.
Responsibility: Metafit is not liable for errors caused by third-party providers. Please direct payment issues to the relevant provider.
Independence: The Metafit App does not integrate with external platforms. No payments or data transactions occur within the app.
Purchasing: Purchases must be made via the Metafit System website or your local franchise site.
DRS Training Pty Ltd retains ownership of the Metafit™ brand, associated programme names, and music tracks.
Licensed content may be used only for live, real-time fitness classes. Online streaming, sharing, or resale is prohibited.
All promotional materials must clearly identify sessions as Metafit™ workouts and display the trademarked logo.
Any infringement, suspected misuse, or challenge to Metafit™ copyrights must be reported in writing immediately.
Local Law Compliance: Users are responsible for ensuring their usage complies with applicable laws and regulations in their jurisdiction, including data privacy.
Non-Compliance Disclaimer: DRS Training Pty Ltd assumes no liability for failure to comply with local legal requirements.
Collection: We collect only necessary personal data (e.g., name, email) to create and manage user accounts.
Usage: Data is used solely for Metafit-related services and is not shared with third parties.
Security: Personal data is protected by encryption, access controls, and regular audits.
Access & Deletion: You may request a copy of or deletion of your personal data at any time by contacting support.
Correction: Users may update their data via the app or by contacting support.
Misuse Consequences: Unauthorised use of the Metafit System may result in immediate suspension and legal action.
GDPR (EU Users): We collect and process personal data only with a lawful basis. EU users have rights to access, correct, delete, or restrict processing of their data.
CCPA (California Users): Users can request data access, deletion, and opt out of data sales (note: we do not sell user data).
International Transfers: All data transfers comply with applicable laws and safeguards.
Availability: Metafit™ does not guarantee uninterrupted service. Access may be interrupted for maintenance or unforeseen issues.
Limitation of Liability: DRS Training Pty Ltd is not liable for any direct or indirect damages resulting from service use.
Indemnity: You agree to indemnify DRS Training Pty Ltd against claims arising from breach or misuse of these terms.
These terms are governed by the laws of England and Wales. Legal disputes will be resolved under the jurisdiction of Australian courts.
We may revise these terms at any time. Significant changes will be communicated via app notifications or email. Continued use of our services constitutes acceptance of the revised terms.
